Terms of Service

1. Who you are contracting with
CutCulator (the "Service") is provided by TUVOTECH PTY LTD, a company registered in South Africa, trading as CutCulator ("we", "us", "our"). These Terms form a binding agreement between you and TUVOTECH PTY LTD.
2. Acceptance
By creating an account, subscribing, or continuing to use the Service, you agree to these Terms. If you do not agree, stop using the Service. If you use the Service on behalf of a business, you confirm you have authority to bind that business; if you use it as an individual, you confirm you are of legal age to enter a contract.
3. The Service
CutCulator is a web application for craft and small-manufacturing businesses that calculates job pricing and profit, and stores materials, blanks, items, customers, suppliers, quotes, orders and payment records. Paid plans unlock additional features as described on our pricing page.
4. Your account
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Tell us promptly if you suspect unauthorised access.
5. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected, for your own business purposes. You must not reverse engineer, decompile, resell or redistribute the Service, or circumvent plan limits, quotas or technical restrictions.
6. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for any unlawful purpose or in breach of applicable law;
- use it for fraud, spam or misleading commercial communications;
- infringe anyone's intellectual property or privacy rights;
- interfere with security — no malware, probing, penetration testing without consent, credential stuffing, scraping or automated bulk extraction of data;
- upload content that is illegal, defamatory or harmful.
7. Your content
You keep ownership of the data and files you put into the Service. You grant us a limited licence to host, store, process and display that content solely to provide and support the Service (for example, rendering your quote PDFs and share links). You are responsible for having the rights to any logo, image or customer data you upload. If a rights-holder contacts us at support@cutculator.com with a valid complaint, we may remove or restrict the content, and repeated infringement may result in account termination.
8. Our intellectual property
We retain all rights, title and interest in the Service, including its software, calculation logic, design, documentation and branding. Nothing in these Terms transfers any of our intellectual property to you.
9. Payment, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing frequency, renewals, cancellation, taxes and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically at the interval you selected until cancelled. Cancelling stops future renewals and you keep access until the end of the paid period. Plan changes take effect immediately and are prorated. See our Refund Policy.
10. Service levels and accuracy
We work to keep the Service available but do not guarantee uninterrupted or error-free performance. Calculations, margins and totals produced by the Service are tools to assist your own commercial judgement — you are responsible for verifying figures before quoting or invoicing your customers.
11. Warranties
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
12. Liability
To the fullest extent permitted by law, we exclude liability for indirect, consequential or special damages, including lost profits, lost revenue, lost data or loss of goodwill. Our aggregate liability arising out of or in connection with these Terms is capped at the fees you paid in the 12 months before the event giving rise to the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
13. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from your content, your unlawful use of the Service, or your breach of these Terms.
14. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and close your account at any time. On termination your licence ends; you can export your data for 30 days, after which we may delete it in line with our Privacy Policy.
15. Changes to the Service and these Terms
We may update the Service and these Terms. Material changes will be reflected by the date at the top of this page, and continued use after that date means you accept the updated Terms.
16. General
You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These Terms are governed by the laws of South Africa, and the courts of South Africa have exclusive jurisdiction, without affecting any mandatory consumer rights in your country of residence.
